Who is legally responsible for my practice's clinical waste?
You are, as the producer. In England the duty of care under section 34 of the Environmental Protection Act 1990 requires you to store waste safely and securely, document every load leaving the premises, check your carrier is registered, and keep the records. Paying a contractor does not transfer that duty.
How do I check a clinical waste carrier is registered?
Ask for their registration number, which starts with CB, and search the Environment Agency's public register of waste carriers, brokers and dealers. Registration is a legal requirement for transporting waste or arranging its disposal, and operating without it carries an unlimited fine.
What is the difference between clinical waste and offensive waste?
Broadly, clinical waste streams cover infectious or potentially infectious material and related hazardous items, while offensive or hygiene waste is unpleasant but not infectious, such as incontinence products. How long do I have to keep clinical waste paperwork?

Do the same rules apply in Scotland, Wales and Northern Ireland?
No. The duty of care exists across the UK but the detail, the registration processes and the regulators differ, and gov.uk directs producers in Scotland, Wales and Northern Ireland to separate guidance. If you run sites in more than one nation, check each one rather than assuming the English process covers them.
